## When to use it

Use when an applicant for, or a holder of, an Australian practising certificate or registration certificate in a Uniform Law jurisdiction has a bankruptcy-related event, a conviction for a serious offence or a tax offence, or is served with a designated show cause notice. The fitness statement is the practitioner's own explanation, settled with the advising lawyer.

## How AI may be used

AI may enter dates from the charge, conviction or notice and list which statutory path the documents appear to engage; the lawyer decides the path and the practitioner writes the fitness explanation.

**AI may:**

- Enter the date of the event, the date of service and the 7-day and 28-day dates from the documents, flagged for checking
- List the allegations in a designated show cause notice beside the certificate condition or insurance fact they refer to

**AI must not:**

- Must not draft the fitness statement or say whether the practitioner is a fit and proper person
- Must not decide that a finding of guilt is or is not a conviction for s 86
- Must not send anything to the regulatory authority

**The lawyer checks:**

- The event is classified as an automatic show cause event, a designated show cause event, a s 51 notice, or more than one of those
- The 7-day notice and the 28-day statement are diarised from the correct start date, and any extension is applied for inside the 28 days
- The statement explains the facts and why the holder is fit and proper, in the practitioner's own account
