## When to use it

Use when a NSW lawyer client wants to challenge a decision about their practising certificate or a local regulatory authority’s determination. This is a preparation checklist, not a guide to the NCAT form.

## Used for these tasks

- [Prepare the application for tribunal review of a licensing or disciplinary decision](https://ailawframework.com/practice/professional-discipline-and-occupational-regulation.md#A63-H20261018-7)

## How AI may be used

AI may compare the decision with the submissions and list differences; the lawyer decides the grounds and prepares the application.

**AI may:**

- Set out the decision’s findings beside the submissions and evidence
- Calculate candidate deadlines from the date of notice, for the lawyer to confirm against the NCAT rules

**AI must not:**

- Must not write the grounds or any affidavit
- Must not lodge the application

**The lawyer checks:**

- The decision is reviewable under s 125 or s 126 and the client has standing
- The NCAT time limit has been checked in the current NCAT legislation and rules and diarised
- A stay is sought if the decision takes effect before review

## Authorities

- [Legal Profession Uniform Law Application Act 2014 (NSW) s 125 (right of review by NCAT about practising and registration certificates), s 126 (review of certain determinations in consumer and disciplinary matters)](https://legislation.nsw.gov.au/view/html/inforce/current/act-2014-016)
- [Legal Profession Uniform Law (NSW) s 299 (determination by the local regulatory authority of unsatisfactory professional conduct)](https://legislation.nsw.gov.au/view/html/inforce/current/act-2014-16a)
