Advice letter to an applicant who has just received a NSW development consent: what it permits, the conditions that need action and when, the 5-year lapsing rule and how to physically commence, modification pathways, and the time limits for review or a Class 1 appeal on conditions.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Planning & Environment](https://ailawframework.com/precedents/planning-and-environment.md)
- Jurisdictions: New South Wales
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 4 authorities it cites, for New South Wales.

## When to use it

Use when a client receives a development consent (or deferred commencement consent) and needs to know what to do next, or when a buyer or financier needs advice on whether an older consent is still alive. Not for complying development certificates or State significant development, which have their own rules.

## Used for these tasks

- [Draft or comment on proposed conditions of consent](https://ailawframework.com/practice/planning-and-environment.md#A12-T1-R3)
- [Turn conditions of consent into a construction and use compliance register](https://ailawframework.com/practice/planning-and-environment.md#A12-A20260923-2)
- [Draft a client advice letter on development prospects and planning risk](https://ailawframework.com/practice/planning-and-environment.md#A12-T1-R14)

## How AI may be used

AI may extract the conditions into the action table and calculate the lapsing and appeal dates from the notice of determination; the lawyer checks each condition and date against the consent and decides the advice on modification, review or appeal.

**AI may:**

- Extract every condition from the notice of determination into the action table, grouped by stage (before construction certificate, before work, during work, before occupation, ongoing)
- Calculate the lapsing date and the 6-month appeal date from the dates on the notice and the NSW planning portal
- Flag conditions that require a later satisfaction decision by council, contributions, bonds or a deferred commencement matter

**AI must not:**

- Must not advise whether work done so far amounts to physical commencement; that depends on the facts and the regulations
- Must not decide whether a proposed change is substantially the same development or which s 4.55 pathway applies
- Must not recommend accepting, reviewing or appealing conditions; that is the lawyer’s advice on the client’s objectives

**The lawyer checks:**

- The date the consent operates from, the lapsing date and any reduced period are read from the consent itself, not assumed
- Every condition requiring action before a construction certificate, before work starts or before occupation is in the table with its trigger
- The review and appeal time limits are calculated from the date the determination was notified or registered on the portal
- Any deferred commencement condition and its own 5-year (or shorter) period is identified

- [Environmental Planning and Assessment Act 1979 (NSW) s 4.55 (modification of consents: minor error or no environmental impact; minimal environmental impact; other modifications; substantially the same development)](https://legislation.nsw.gov.au/view/whole/html/inforce/current/act-1979-203)
- [Environmental Planning and Assessment Act 1979 (NSW) ss 8.7, 8.9A, 8.10 and 8.11 (applicant appeals, including against later satisfaction decisions under conditions; no appeal during a Division 8.2 review; 6-month limit; deemed refusal)](https://legislation.nsw.gov.au/view/whole/html/inforce/current/act-1979-203)
