Guide to preparing and lodging a NSW workers compensation dispute in the Personal Injury Commission through the Pathway portal after the 2025-2026 reforms, including pre-conditions, evidence and the Commission's generative AI rules (PIC13).

## Key facts

- Kind: Court document. A document filed or served in a court or tribunal.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: New South Wales
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the official form at pi.nsw.gov.au and the 6 authorities it cites, for New South Wales.

## When to use it

Use for a NSW workers compensation dispute about liability, weekly payments, medical expenses or permanent impairment. Lodge only through the Commission's Pathway portal on the current application. Other states have different schemes and tribunals.

## How AI may be used

AI can build a cited chronology and issues list from medical and payroll records in an approved secure tool, but the application, the dispute framing and every statement of evidence are the lawyer's, and PIC13 limits AI use on statements and expert reports.

**AI may:**

- Build a treatment and payments chronology from permitted records, with a page reference for each entry.
- Compare the insurer's decision notice with the issues the worker wants to dispute and list what was not raised before the insurer.
- Index and paginate the documents the lawyer has selected for lodgment.

**AI must not:**

- Must not generate or rephrase the content of the worker's statement or any witness statement (PIC13 para 12; r 33A).
- Must not receive material produced under a direction for production, or subject to non-publication directions, unless PIC13 para 10 conditions are met.
- Must not be joined to any Commission conference or hearing, including transcription or note-taking tools (r 133B).

**The lawyer checks:**

- The dispute type, pre-conditions and any internal review step are satisfied before lodgment.
- Every statement contains the PIC13 disclosure that generative AI was not used to generate its content.
- Submissions prepared with AI verify that all citations exist, are accurate and are relevant (r 133C), checked by a person.
- The current entitlement rules after the 2025-2026 reforms have been applied to this claim's dates.
