## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Victoria
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the authority it cites, for Victoria.

## When to use it

Use when a Victorian worker may claim a lump-sum impairment benefit, separate from weekly payments and from a common law damages application. Do not use it for the serious-injury common law steps.

## Used for these tasks

- [Draft the pre-action notice or statutory claim form from the instructions](https://ailawframework.com/practice/personal-injury-and-compensation/draft-the-pre-action-notice-or-statutory-claim-form-from-the-instruction.md)
- [Test an injury against the statutory threshold for benefits or damages](https://ailawframework.com/practice/personal-injury-and-compensation/test-an-injury-against-the-statutory-threshold-for-benefits-or-damages.md)
- [Summarise medical reports for a whole-person impairment assessment](https://ailawframework.com/practice/personal-injury-and-compensation/summarise-medical-reports-for-a-whole-person-impairment-assessment.md)

## How AI may be used

The tool may list the injury, the injury date and the reports already held, and flag whether 12 months have passed, and the lawyer decides whether the injury is stable and which threshold applies.

**AI may:**

- Calculate whether 12 months have passed since the injury date the lawyer enters
- Index treating reports that comment on whether the impairment is stable
- Draft the short letter to the agent with square-bracket gaps for the claim number and the injuries

**AI must not:**

- Must not state a percentage threshold. The page reviewed on 17 July 2026 says thresholds exist and does not state one
- Must not describe this benefit as the common law serious-injury application
- Must not complete a worker's claim form that was not opened, or put the file into a public tool

**The lawyer checks:**

- The current Act and the impairment guidelines are opened before any percentage or table is used. Neither was opened for this checklist
- Stability is a medical question. The page says the injury is usually stable at least 12 months after the injury date, and that is not a rule that it is always so
- The worker is told that a lawyer is optional and that WorkSafe does not cover those legal costs, and is also told that impairment-benefit protocols exist
- Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
