## Key facts

- Kind: Court document. A document filed or served in a court or tribunal.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Victoria, Queensland, New South Wales
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the 8 authorities it cites, for Victoria, Queensland and New South Wales.

## When to use it

Use when a plaintiff firm sets out the heads of loss for a personal injury claim that will be served, included in a court book, or used to instruct an expert. In Queensland, adapt Part B so the document can be signed and served as the statement of loss and damage. Do not use the figures below for a transport-accident or workers-compensation damages claim until the lawyer confirms that these Acts apply.

## Used for these tasks

- [Prepare a damages or statutory-entitlements schedule](https://ailawframework.com/practice/personal-injury-and-compensation/prepare-a-damages-or-statutory-entitlements-schedule.md)
- [Draft a letter of demand or particulars of injury from the schedule](https://ailawframework.com/practice/personal-injury-and-compensation/draft-a-letter-of-demand-or-particulars-of-injury-from-the-schedule.md)
- [Check a claim for gratuitous attendant care against the statutory threshold](https://ailawframework.com/practice/personal-injury-and-compensation/check-a-claim-for-gratuitous-attendant-care-against-the-statutory-thresh.md)
- [Apply the statutory table for non-economic loss damages](https://ailawframework.com/practice/personal-injury-and-compensation/apply-the-statutory-table-for-non-economic-loss-damages.md)
- [Set out the assumptions required for future economic loss](https://ailawframework.com/practice/personal-injury-and-compensation/set-out-the-assumptions-required-for-future-economic-loss.md)

## How AI may be used

The tool may assemble the schedule from figures, assumptions and page references the lawyer has already adopted, and it must leave every unadopted amount blank.

**AI may:**

- Lay out the heads in Part A and copy in only amounts, dates and page references the lawyer has marked as adopted
- Flag a head that is still blank, a period with no invoice or wage record, and a total that does not add up
- In Queensland, arrange the adopted material under the topics in Uniform Civil Procedure Rules 1999 r 547(3)

**AI must not:**

- Must not choose a percentage of a most extreme case, an injury scale value, a weekly loss, a discount rate or a care rate
- Must not insert an indexed cap, average weekly earnings figure or superannuation rate from memory, or reuse a figure from another matter
- Must not sign the statement, file or serve it, or write anything in a statutory declaration or verification
- Must not generate the content of an affidavit or the words of a witness's evidence

**The lawyer checks:**

- Confirm which Act applies. Transport-accident and workers-compensation statutes can displace the Wrongs Act and the Civil Liability Acts
- Check every figure, date and page reference against the source record before the schedule is signed, served or given to the court
- Health, wage and Centrelink records stay in a firm-controlled tool. Check confidentiality under ASCR r 9, security under APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth)
- In Victoria, if the schedule is provided to the Court, verify it under Practice Note SC Gen 25. In New South Wales, Practice Note SC Gen 23 para 10 prohibits generative AI in the content of an affidavit
