## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Victoria, Queensland, New South Wales
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the 9 authorities it cites, for Victoria, Queensland and New South Wales.

## When to use it

Use when an injured person proposes to claim over the condition of a road, footpath or road infrastructure. In Victoria, send it within 30 days of the incident to the responsible road authority. It does not replace a Queensland notice of claim or a motor accident claim form.

## Used for these tasks

## How AI may be used

The lawyer and the tool complete the notice from the instructions and a map or photograph of the site, and the lawyer checks the authority, the 30 day count and every particular before it is sent.

**AI may:**

- Fill the reg 14 particulars from the instructions, the site description and the date of the letter
- Name the responsible road authority the lawyer has identified, and no other
- Ask for inspection, complaint and works records for the site and the period the lawyer sets

**AI must not:**

- Must not decide which body is the responsible road authority
- Must not say the authority is liable, or that actual knowledge is proved
- Must not apply the property-damage threshold to a personal injury
- Must not treat this letter as a Queensland notice of claim or a motor accident claim

**The lawyer checks:**

- The recipient is the responsible road authority for that road, checked against the register or the council
- In Victoria, every particular in reg 14 is in the letter and it goes within 30 days of the incident
- The request for records is limited to the site and the period that matter to actual knowledge
- Draft only in the firm's approved tool. In Victoria and New South Wales, do not disclose confidential client information without authority under Australian Solicitors' Conduct Rules r 9.2.1. A Queensland solicitor checks the local conduct rules.
- If client information leaves the approved environment, check APP 11 and whether there is an eligible data breach under the Privacy Act notifiable data breach scheme.
