## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Queensland
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23

## When to use it

Use when a Queensland worker, or another claimant entitled to claim damages for a work injury, is preparing the approved notice of claim for damages. Do not use it for the statutory weekly-payments claim, or for a QIRC appeal.

## Used for these tasks

- [Calculate limitation and pre-action notice deadlines from the injury facts](https://ailawframework.com/practice/personal-injury-and-compensation/calculate-limitation-and-pre-action-notice-deadlines-from-the-injury-fac.md)
- [Draft the pre-action notice or statutory claim form from the instructions](https://ailawframework.com/practice/personal-injury-and-compensation/draft-the-pre-action-notice-or-statutory-claim-form-from-the-instruction.md)
- [Prepare a damages or statutory-entitlements schedule](https://ailawframework.com/practice/personal-injury-and-compensation/prepare-a-damages-or-statutory-entitlements-schedule.md)

## How AI may be used

The tool may build the exhibit list and flag missing section 275 items from the file, and the lawyer writes the notice, the offer and the statutory declaration, and decides whether the limitation period is protected.

**AI may:**

- List section 275(6) to (8) items against documents already held, including the notice of assessment
- Extract dates of injury, employment and the notice of assessment into a chronology for the lawyer to check
- Mark Form 275 section 1 if a section 276 waiver is being asked for, without writing the reasons

**AI must not:**

- Must not write or complete the statutory declaration. Section 275(5) requires verification of statements in the claimant's personal knowledge, and Form 275 version 3 contains that declaration
- Must not state a degree of permanent impairment threshold, or the length of the general limitation period. Those figures were not read in the Act for this checklist
- Must not advise the client that section 302(1)(b) or Schedule 5 has extended the period

**The lawyer checks:**

- The current approved form is downloaded on the day of use. Form 275 version 3 was the PDF opened on 23 October 2026
- Section 302(2) is satisfied before the limitation period ends: complying notice, waiver, a section 297 declaration, or section 298 leave
- The declaration is signed by the claimant before a justice of the peace, commissioner for declarations or solicitor, as the form states
- Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
