## When to use it

Use when a person injured in a Queensland motor vehicle accident must give notice to a CTP insurer or the Nominal Defendant, or must answer a notice under section 39. Do not use it for a New South Wales or Victorian claim.

## Used for these tasks

- [Calculate limitation and pre-action notice deadlines from the injury facts](https://ailawframework.com/practice/personal-injury-and-compensation/calculate-limitation-and-pre-action-notice-deadlines-from-the-injury-fac.md)
- [Draft the pre-action notice or statutory claim form from the instructions](https://ailawframework.com/practice/personal-injury-and-compensation/draft-the-pre-action-notice-or-statutory-claim-form-from-the-instruction.md)

## How AI may be used

The tool may assemble the checklist and a reply to a noncompliance notice from the insurer's letter and the file, and the lawyer settles the notice and writes nothing in the witnessed part of the form.

**AI may:**

- Calculate the earlier of the dates in section 37(2) from the accident date and the date a lawyer was first consulted
- List the documents section 37 and the regulation require, against what is already on the file
- Draft a reply that answers each noncompliance the insurer has identified, with a gap where a fact is missing

**AI must not:**

- Must not complete, sign or witness the Notice of Accident Claim Form. Both the portal printout and the PDF are signed before an eligible witness
- Must not decide that a delay is reasonably excused, or that the Nominal Defendant claim is still open
- Must not send the claim file to a public tool

**The lawyer checks:**

- Section 37(2) and (3) are applied to this accident: unidentified vehicle, ordinary vehicle, or a lawyer already consulted
- A law practice certificate accompanies the notice if a law practice is retained (s 37(1)(d))
- The insurer's section 39 notice is diarised, including the period of at least one month it allows
- Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
