## Key facts

- Kind: Other. A precedent that fits none of the other kinds.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Queensland
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the 3 authorities it cites, for Queensland.

## When to use it

Use when Queensland general damages for an injury arising after 1 December 2002 are calculated from an injury scale value. The lawyer assigns the value. The tool looks up nothing until the lawyer names the notice for that year.

## Used for these tasks

- [Record the current maximum or scale for non-economic loss](https://ailawframework.com/practice/personal-injury-and-compensation/record-the-current-maximum-or-scale-for-non-economic-loss.md)

## How AI may be used

The tool records the injury scale value the lawyer assigns and multiplies only by the base and variable the lawyer copies from the notice for the year the injury arose.

**AI may:**

- Record an injury scale value between 0 and 100 that the lawyer has assigned.
- Add the base and the variable the lawyer copies from the notice for the period in which the injury arose.
- Keep the section 58 and section 64 amounts, which section 75 also fixes, off the general damages total.

**AI must not:**

- Do not assign the injury scale value.
- Do not copy a dollar table into the sheet. Section 62 uses the notice for the period in which the injury arose, and a table for another year is the wrong notice.
- Do not apply injury-range rules in a regulation. Section 61(1)(c)(i) refers to them and they were not opened.
- Do not add the amount fixed for section 58(1)(b) or section 64(2).

**The lawyer checks:**

- Confirm chapter 3 applies to this award.
- Assign the injury scale value, applying any regulation rules and having regard to values given to similar injuries.
- If the value is outside the range for similar injuries, state the factors, as section 61(2) requires.
- Name the Minister's notice for the financial year in which the injury arose and copy the base and variable from it.
- Keep wage and medical records in the firm's system. Check Australian Solicitors' Conduct Rules rule 9, Australian Privacy Principle 11, and whether a breach would be notifiable under the Privacy Act 1988 (Cth).
