## When to use it

Use when the dust claim depends on which product was on a site, or who supplied it. The recipient is an employer, an occupier, a supplier or a manufacturer. The letter asks for identification. It does not allege a breach of a state work-health regulation.

## How AI may be used

AI may prepare the identification request from the sites and years the lawyer has accepted, and the lawyer checks the product description before it is sent.

**AI may:**

- Ask the recipient to identify the product, the supplier and the years from its own records
- Set out Safe Work Australia's published definition of engineered stone, and say the state regulation was not quoted
- Ask the recipient to preserve labels, invoices and safety data sheets

**AI must not:**

- Must not allege that the recipient committed an offence under a state regulation
- Must not state a date on which asbestos was banned
- Must not direct anyone to cut, process or sample stone
- Must not treat Safe Work Australia's page as the text of the New South Wales, Victorian or Queensland regulation

**The lawyer checks:**

- The local work-health regulation is read before any breach is alleged. Safe Work Australia says implementation may vary
- The product is described only as far as the instructions and the records go. A trade name is not invented
- A sample, if one exists, is preserved. The letter does not tell the recipient to process engineered stone
- The letter is not the Dust Diseases Tribunal asbestos lodgment form
