## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: New South Wales
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the authority it cites, for New South Wales.

## When to use it

Use when an interim participant in the New South Wales Lifetime Care and Support Scheme is near the end of the two years and asks to become a lifetime participant. Do not use it to complete the interim application or the medical certificate, or to dispute a decision. A dispute uses the eligibility-dispute letter.

## How AI may be used

The tool may assemble the request and match reports already on the file to the injury type, and the lawyer decides whether the criteria are met and which scores the reports actually state.

**AI may:**

- Record the accident date, whether the person was under 16 on that date, and the interim acceptance date
- List which injury type on the who-we-care-for page the reports address
- Quote a FIM, WeeFIM, Snellen, field, burn percentage or amputation level only where a report already states it

**AI must not:**

- Must not complete the interim application, the consent or the specialist's medical certificate
- Must not decide that the injury meets the Guidelines, or add an ASIA grade. The spinal-cord eligibility text that was read states a permanent neurological deficit and does not state a grade
- Must not describe this as the ACT Lifetime Care and Support Scheme, or as a CTP damages claim
- Must not copy an exclusion from the reasonable-and-necessary information sheet. That PDF was not opened

**The lawyer checks:**

- The page says the person was injured in a motor accident in NSW on or after 1 October 2006 if under 16, or on or after 1 October 2007 if an adult, the injury was caused by the motor accident, and the type and severity meet the Lifetime Care and Support Guidelines. The Guidelines and the Act were not opened
- The page says the scheme was established under the Motor Accidents (Lifetime Care and Support) Act 2006 and is run by the Lifetime Care and Support Authority, part of icare, funded by a levy on NSW green slips. It is no-fault
- An eligible person is an interim participant for two years. Towards the end of that period the person can apply to become a lifetime participant. Lifetime participation means icare continues to pay for treatment, rehabilitation and care that is reasonable and necessary and related to the motor accident injury for the rest of the person's life
- Reasonable and necessary, on the page, includes how the service relates to the person's goals and participation, whether the service and the provider are appropriate, whether it is cost-effective, and how it relates to the motor accident injury. The information sheet of things the scheme cannot pay for was not opened
- Injury criteria below are the who-we-care-for page's words. The tool does not apply them. The lawyer does
- The interim application page is a separate link precedent. This letter does not replace that form
- Health, wage and scheme records stay in the firm's approved tool. ASCR r 9 and APP 11 apply. A breach may be notifiable under the Privacy Act 1988 (Cth).
