## When to use it

Use for a claimant who wants the insurer, not the Personal Injury Commission, to review a decision. Keep either the motor accident part or the workers compensation part. For a motor accident, send it within 28 days of receiving the decision notice unless the lawyer has decided to make a late request.

## Used for these tasks

- [Draft correspondence to the insurer or scheme agent](https://ailawframework.com/practice/personal-injury-and-compensation/draft-correspondence-to-the-insurer-or-scheme-agent.md)
- [Prepare a CTP or workers compensation dispute submission from the scheme file](https://ailawframework.com/practice/personal-injury-and-compensation/prepare-a-ctp-or-workers-compensation-dispute-submission-from-the-scheme.md)
- [Review a work capacity decision against the capacity evidence](https://ailawframework.com/practice/personal-injury-and-compensation/review-a-work-capacity-decision-against-the-capacity-evidence.md)

## How AI may be used

The lawyer and the tool draft one part of the letter from the decision notice, and the lawyer checks that the decision is reviewable and that the request is in time before it is sent.

**AI may:**

- Copy the decision, the date of notice and the outcome from the insurer's letter
- State the alternative decision and the reasons from the lawyer's instructions
- Attach only documents the lawyer has marked as relevant to the review

**AI must not:**

- Must not leave both the motor accident part and the workers compensation part in the same letter
- Must not describe the request as an application to the Personal Injury Commission
- Must not say the original decision is stayed
- Must not promise that legal costs of the motor accident internal review will be recovered

**The lawyer checks:**

- For a motor accident, the decision is one section 7.9 covers and the 28 days are counted from receipt of the notice
- For workers compensation, the decision is a work capacity decision, a PIAWE decision, or a claim the insurer disputes, and the dispute has not been referred to the Commission
- The SIRA workers compensation form is used where the insurer expects it, and the reforms page is checked before sending
- Draft only in the firm's approved tool. In Victoria and New South Wales, do not disclose confidential client information without authority under Australian Solicitors' Conduct Rules r 9.2.1. A Queensland solicitor checks the local conduct rules.
- If client information leaves the approved environment, check APP 11 and whether there is an eligible data breach under the Privacy Act notifiable data breach scheme.
