Letter of claim to a public health service. In Queensland it is an initial notice under the Personal Injuries Proceedings Act 2002 s 9A, and the Victorian and New South Wales variants ask the service to confirm the defendant.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Queensland, Victoria, New South Wales
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the 3 authorities it cites, for Queensland, Victoria and New South Wales.

## When to use it

Use when a public health service is the proposed defendant for a treatment injury. In Queensland, use it as the section 9A initial notice, before part 1 of a section 9 notice. In Victoria and New South Wales, use it to notify the service and to ask it to name the correct entity and insurer.

## How AI may be used

AI may assemble the notice from the instructions and from an expert report the lawyer has opened; the lawyer decides that section 9A applies, sets any excuse for delay, and approves the allegations before the letter is sent.

**AI may:**

- Fill the section 9A particulars from the instructions: names, date of birth, services, dates, places and a description of the injury
- Ask the recipient to confirm the legal entity and the insurer, and to provide the documents section 9A(8) requires in a Queensland matter
- Quote a breach allegation only in words taken from an expert report the lawyer has opened

**AI must not:**

- Must not present this letter as part 1 of a Queensland section 9 notice, or as the specialist report required with that part
- Must not draft the law practice certificate under section 8C
- Must not state a limitation date, a significant-injury threshold, or a peer-opinion test other than Wrongs Act 1958 (Vic) s 59 or Civil Liability Act 2002 (NSW) s 5O
- Must not name a section of the Hospital and Health Boards Act 2011 as the source of a right to sue

**The lawyer checks:**

- In Queensland, the incident is a medical incident happening on or after the commencement of section 9A, the letter says it is given under section 9A, and every particular in section 9A(3) is filled from the instructions
- The time in section 9A(4) is diarised: the earlier of 9 months after the incident or the first appearance of symptoms, and 1 month after the claimant first instructs a law practice and the proposed defendant is identified. A consultation with a community legal service is disregarded for that second limb
- If a law practice is retained, the supervising principal's section 8C certificate accompanies the notice. The text of section 8C was not used to draft that certificate
- If the proposed defendant is the State or has the privileges and immunities of the State, the notice goes to the health service chief executive of the Hospital and Health Service that controls the place, or otherwise to the chief executive of the department or entity that controls the place
- Breach allegations are taken from an opened report. Victorian peer-opinion questions are framed under section 59, and New South Wales questions under section 5O
- Health information stays in a firm-approved tool. The lawyer applies Australian Solicitors' Conduct Rules rule 9 and Australian Privacy Principle 11, and considers whether any breach is notifiable under the Privacy Act 1988 (Cth)
