Questions for the first contact with an injured person: who is enquiring, age and capacity, how the injury happened, which schemes might apply, treatment and work, and the documents to keep. The person signs that the answers are true, and it is not a statutory declaration.

## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Victoria, Queensland, New South Wales
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the 3 authorities it cites, for Victoria, Queensland and New South Wales.

## When to use it

Use at the first contact, before a retainer is signed, to decide whether the firm can act and which clocks to diary. Do not use it as a notice of claim, a witness statement or an affidavit. If a later scheme form has a statutory declaration, the client completes that part.

## How AI may be used

The tool may turn the enquiry notes into a completed questionnaire for the client to read and correct, and the lawyer checks every answer before the file is opened.

**AI may:**

- Arrange the caller's words under the questions, leaving a blank where the caller did not answer
- List dates, treating names and employers exactly as the caller gave them
- Flag a possible work, transport, public-place, treatment or product setting so the lawyer can diary the right notice

**AI must not:**

- Must not invent a date, a witness, a diagnosis or an employer
- Must not write a statutory declaration, an affidavit or a witness statement from these answers
- Must not put health, wage or Centrelink information into a tool outside the firm's approved environment

**The lawyer checks:**

- The client has read the answers, corrected them, and signed only the acknowledgement, not a statutory declaration
- Age, a substitute decision-maker and an interpreter are recorded before anyone is asked to sign
- Health information stays in the firm's approved system (ASCR r 9; APP 11). A loss that is likely to cause serious harm is assessed under the Notifiable Data Breaches scheme
