- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: Queensland
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.

## When to use it

Use when a law practice is retained on a Queensland CTP claim and must give a law practice certificate under the Motor Accident Insurance Act 1994. The page is the MAIC certificate. A PIPA or workers' compensation certificate is a different statutory certificate. The lawyer does not use this for an unrepresented claimant.

## Used for these tasks

- [Draft the pre-action notice or statutory claim form from the instructions](https://ailawframework.com/practice/personal-injury-and-compensation/draft-the-pre-action-notice-or-statutory-claim-form-from-the-instruction.md)
- [Draft a settlement advice and conference paper](https://ailawframework.com/practice/personal-injury-and-compensation/draft-a-settlement-advice-and-conference-paper.md)

## How AI may be used

AI may list the stages at which the Act and the MAIC page require a certificate; it writes nothing in the certificate or its statutory declaration, and the supervising principal signs it.

**AI may:**

- List the statutory stages already identified on the file at which a certificate is required
- Check the file for a certificate from the supervising principal and for any copy received under section 36E
- Record the nomination under section 36C(2)(b) if the only principal has a planned absence

**AI must not:**

- Must not write the certificate, the statutory declaration, or the claim-farming statements
- Must not decide whether section 74 or section 75 applies, or whether a costs agreement complies
- Must not sign or give the certificate

**The lawyer checks:**

- The certificate is the commission's approved form for this CTP claim, signed by the supervising principal
- Section 36A is met before notice if the practice was retained first; section 37AB is met within 1 month if the practice is retained after notice
- A speculative personal injury claim also states compliance with section 79 or the Legal Profession Act 2007, section 347
- The MAIC page's figure of 300 penalty units, stated as $51,810 for an individual from 1 July 2026, is checked before it is repeated
