## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Personal Injury & Compensation](https://ailawframework.com/precedents/personal-injury-and-compensation.md)
- Jurisdictions: New South Wales
- AI level: Red. You write the text. The tool writes nothing into the document. Where permitted, it may check, clarify or collect data, and anything it checks or collects is verified.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the official form at ucprforms.nsw.gov.au and the 4 authorities it cites, for New South Wales.

## When to use it

Use when a legally represented plaintiff files a statement of claim in a New South Wales court under the Uniform Civil Procedure Rules 2005. A plaintiff acting in person uses Form 3B, which is a different form.

## Used for these tasks

- [Draft pleadings or points of claim from the medical chronology](https://ailawframework.com/practice/personal-injury-and-compensation/draft-pleadings-or-points-of-claim-from-the-medical-chronology.md)
- [Calculate limitation and pre-action notice deadlines from the injury facts](https://ailawframework.com/practice/personal-injury-and-compensation/calculate-limitation-and-pre-action-notice-deadlines-from-the-injury-fac.md)

## How AI may be used

The tool writes nothing in the statement of claim and nothing in the affidavit verifying, and it may only list dates, parties and documents already on the file for the lawyer who writes the pleading.

**AI may:**

- List parties, the date of injury and the court from documents already on the file
- Index medical reports and economic material by date so the lawyer can decide what the pleading relies on
- Note whether the file records a limitation date that should be checked before filing

**AI must not:**

- Must not write any pleading, particular, or the relief claimed
- Must not write the affidavit verifying, or any scaffold or outline of the deponent's evidence
- Must not write the clause 4 Schedule 2 certificate or decide whether that certificate is required
- Must not file the statement of claim

**The lawyer checks:**

- Download Form 3A version 7 from the current UCPR list. The PDF filename is ucpr_form_3a_v71.pdf. The list calls it version 7
- Choose the type of claim from the list published on the UCPR site
- The form offers either a certificate under clause 4 of Schedule 2 to the Legal Profession Uniform Law Application Act 2014, or a statement that the certificate is not required
- The notice tells the defendant to file a defence within 28 days of service or be in default, and says the court may enter judgment without further notice
- Do not include the affidavit verifying in Local Court proceedings. The form says to check the Rules for other cases where an affidavit is not required. The deponent and witness sign each page. The form cites UCPR 35.7B
- Practice Note SC Gen 23 paragraph 10 says generative artificial intelligence must not generate the content of an affidavit. It was issued on 28 January 2025 and commences on 3 February 2025. The District Court practice note adopts SC Gen 23 and commences on 3 February 2025
- Health, wage and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).
