## When to use it

Use when a plaintiff firm needs the employer's wage records and the workplace incident documents for an injured worker. Lodge the workers compensation claim on the insurer's or authority's own form. Do not use this letter as that claim.

## Used for these tasks

- [Draft correspondence to the insurer or scheme agent](https://ailawframework.com/practice/personal-injury-and-compensation/draft-correspondence-to-the-insurer-or-scheme-agent.md)
- [Reconcile the claim form with the medical chronology and payroll evidence](https://ailawframework.com/practice/personal-injury-and-compensation/reconcile-the-claim-form-with-the-medical-chronology-and-payroll-evidenc.md)

## How AI may be used

The lawyer and the tool draft the letter from the intake and the signed authority, and the lawyer checks the date range and the enclosed authority before it is sent.

**AI may:**

- Fill the employment dates, the incident date and the record list from the intake
- Attach only the authority the client has signed
- Track what is asked for and what comes back

**AI must not:**

- Must not ask for records outside the period and the types the client has authorised
- Must not describe this letter as the workers compensation claim
- Must not assert that the Fair Work Act requires the employer to keep or produce footage or an incident report
- Must not send medical information to the employer

**The lawyer checks:**

- The signed authority covers the employer, the period and the record types
- The wage request is limited to the worker's own time and wage records
- The claim form for the state scheme is lodged separately, on the form that scheme requires
- Draft only in the firm's approved tool. In Victoria and New South Wales, do not disclose confidential client information without authority under Australian Solicitors' Conduct Rules r 9.2.1. A Queensland solicitor checks the local conduct rules.
- If client information leaves the approved environment, check APP 11 and whether there is an eligible data breach under the Privacy Act notifiable data breach scheme.
