A provider's checklist and timeline for reportable incidents: whether an incident falls in a reportable category, when the provider became aware, the 24-hour and 5-business-day reports, unauthorised restrictive practices, and the record of what was lodged and when.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [NDIS & Disability Law](https://ailawframework.com/precedents/ndis-and-disability-law.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Green. AI can do most of the drafting. A lawyer still reviews the result.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 2 authorities it cites, for Australia and Commonwealth.

## When to use it

Use as soon as a registered NDIS provider becomes aware of an incident, or an allegation of one, in connection with its supports or services, and when a lawyer reviews whether a provider met its notification obligations.

## How AI may be used

AI may complete this validated checklist and timeline from incident records, rosters and notes, and calculate the reporting deadlines from the awareness time; the provider's lawyer checks the template at setup, and a responsible person confirms each classification.

**AI may:**

- Build the timeline of the incident, when each staff member and the provider became aware, and each report lodged
- Calculate the 24-hour and 5-business-day deadlines from the awareness time entered
- Flag incident records that mention injury, abuse, neglect, assault, sexual misconduct or a restrictive practice for human assessment

**AI must not:**

- Must not decide that an incident is not reportable, or delay a report while a classification is discussed
- Must not lodge reports in the NDIS Commission portal
- Must not record more personal or health information about participants than the report and the file need

**The lawyer checks:**

- The checklist categories and timeframes match the Commission's current guidance when the template is set up
- The awareness time is recorded accurately, including when the first worker became aware, and checked against what the rules treat as the provider becoming aware
- Each incident in a reportable category has a 24-hour report (where required) and a 5-day report, lodged on time
- Any late or missed report is identified and the provider is advised on remedying it and on possible compliance action
