A structure for written submissions by an NDIS provider, key personnel or worker answering a notice that the Commissioner is considering revoking registration or making a banning order: grounds, facts, remediation, the statutory matters, and what follows if the decision is made.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [NDIS & Disability Law](https://ailawframework.com/precedents/ndis-and-disability-law.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Red. Keep AI out of the decisive steps. A lawyer does the work.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 4 authorities it cites, for Australia and Commonwealth.

## When to use it

Use when the NDIS Quality and Safeguards Commission gives notice that it is considering revoking a provider's registration (s 73P) or making a banning order (s 73ZN) and invites submissions. Diarise the submission deadline on the day the notice arrives.

## How AI may be used

The lawyer writes the submissions; AI may only organise the Commission's notice into an allegations table, index the provider's records against it and check the submissions against the statutory matters.

**AI may:**

- Break the Commission's notice and reasons into a numbered table of allegations and grounds
- Index incident reports, policies, training records, audits and correspondence against each allegation
- Check the final submissions address every allegation and every matter in s 73P(2)

**AI must not:**

- Must not draft any text of the submissions or any statement from staff, participants or key personnel
- Must not prepare or outline any statutory declaration or affidavit; sworn evidence is written by the person giving it
- Must not summarise participants' personal or health information beyond what the lawyer needs, or put it in an unapproved tool

**The lawyer checks:**

- The deadline in the notice (at least 28 days for revocation) is diarised, and any extension is sought in writing early
- Each allegation is answered with evidence, and admitted matters are dealt with candidly with the remediation taken
- The submissions address the nature, significance and persistence of any contravention, what can be done to address it, public trust in the scheme, and participants' health, safety and wellbeing
- The client understands that a later decision takes effect despite an internal review request, and the 3-month and 28-day review deadlines
