## When to use it

Use when a participant, plan nominee or child representative is asking the NDIA to vary a plan or to reassess it. Delete the unused part. Do not use it for an internal review of a decision, and do not use the high support needs box until the current criteria page has been read.

## Used for these tasks

- [Prepare a request to vary or reassess an NDIS plan](https://ailawframework.com/practice/ndis-and-disability-law.md#A55-P20261018-2)
- [Prepare a high support needs variation request after a budget reduction](https://ailawframework.com/practice/ndis-and-disability-law.md#A55-P20261018-3)

## How AI may be used

AI may complete the participant number, the plan dates and the list of attached reports from the file, and delete the unused part when the lawyer has said which request it is. The lawyer approves every sentence before it is sent.

**AI may:**

- Insert the participant number, plan dates and the titles and dates of reports that are actually attached
- Delete Part A or Part B after the lawyer says which request is being made
- Leave the high support needs box blank unless the lawyer has read the current criteria

**AI must not:**

- Must not send both parts for the same change
- Must not say the high support needs criteria are met
- Must not have a provider ask for a reassessment
- Must not describe using up the funding, by itself, as an emergency
- Must not send the letter

**The lawyer checks:**

- The unused part is deleted, and the current NDIA form is completed as well as this letter
- The person asking is the participant, the plan nominee or the child representative, and any consent is in writing where the variation page requires it
- Reassessment evidence is after the current plan was approved and, unless there is a reason on the file, within 4 months of the request
- The NDIA pages are re-read. Both pages say the website is being updated and that some information may change
