A checklist for reviewing a behaviour support plan that contains regulated restrictive practices: registration, plan timeframes, consultation and functional behaviour assessment, the conditions each practice must meet, state or territory authorisation, lodgement, monthly reporting and plan review.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [NDIS & Disability Law](https://ailawframework.com/precedents/ndis-and-disability-law.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 2 authorities it cites, for Australia and Commonwealth.

## When to use it

Use when advising a participant, family, guardian or provider about a behaviour support plan that includes a regulated restrictive practice, or auditing a provider's compliance. The state or territory authorisation process must be checked separately for where the participant lives.

## Used for these tasks

- [Review a behaviour support plan and its restrictive practice authorisation](https://ailawframework.com/practice/ndis-and-disability-law.md#A55-N20261018-9)

## How AI may be used

AI may extract each restrictive practice, date, authorisation and report from the plan and the provider's records into the checklist; the lawyer decides whether each requirement is met and what to advise.

**AI may:**

- List each regulated restrictive practice in the plan with its description, triggers and fade-out strategy
- Build a timeline of first use, engagement of the practitioner, interim and comprehensive plans, authorisation, lodgement and monthly reports
- Flag missing documents and gaps between the plan and incident or monthly reports

**AI must not:**

- Must not assess whether a practice is the least restrictive option, proportionate or a last resort
- Must not decide whether a use was authorised under the state or territory framework
- Must not summarise behavioural or health information about the participant beyond what the lawyer needs

**The lawyer checks:**

- The implementing provider is registered for implementing behaviour support plans, and the plan was developed by an NDIS behaviour support practitioner
- Each practice is clearly stated, authorised by the state or territory body, and meets the conditions of last resort, shortest time, risk reduction, proportionality and least restriction
- Interim and comprehensive plans were in place within the required times, and the comprehensive plan has been reviewed at least every 12 months
- Any use outside the plan or without authorisation has been treated as a possible reportable incident
