## When to use it

Use when a Government party gives notice under s 29 of a proposed future act (for example a mining lease or exploration permit) and you act for a native title party, a representative body or the grantee party. Start it the day the notice is received. For an objection to the expedited procedure statement, use the separate lodgement guide in this library.

## How AI may be used

AI may calculate the statutory dates from the notification day and keep the negotiation log in order; the lawyer confirms the dates against the notice, decides on objection and negotiation strategy, and works with the native title party under its own decision-making processes.

**AI may:**

- Calculate the 3-month, 4-month and 6-month dates from the notification day stated in the notice, and flag any date already passed
- Build the negotiation log from correspondence the lawyer provides: date, parties present, offers and responses
- Check the tenement or act details in the notice against the area map and list overlapping claims or determinations the lawyer has identified

**AI must not:**

- Must not infer or record anything about the native title party’s connection, rights, sites or internal views; those come only from the party, through its own processes
- Must not decide whether to object to the expedited procedure, or advise on whether a party has negotiated in good faith
- Must not put cultural, genealogical or restricted information into any tool without the native title party’s informed consent and an approved environment

**The lawyer checks:**

- The notification day and every date in the diary are taken from the notice itself and recalculated by hand
- The client’s status as a native title party under s 29(2) or s 30 is confirmed from the registers, including any claim that must be filed within 3 months
- Instructions on objection, negotiation and any agreement come through the native title party’s authorised decision-making process (including the PBC regulations for a registered native title body corporate)
- The good faith record is complete enough to support or resist an argument under s 36(2) before any s 35 application
