## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Military & Defence Law](https://ailawframework.com/precedents/military-and-defence-law.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the authority it cites, for Australia and Commonwealth.

## When to use it

Use when the Office of the IGADF contacts a member, a witness, or a family about an inquiry, including an inquiry into the death of an ADF member. It records the notices and the rights the IGADF's own questions-and-answers page states. It is not a witness statement.

## How AI may be used

AI may list the notices and proposed findings received and index the inquiry material; the lawyer decides what is said to the inquiry and what is compulsory.

**AI may:**

- Index the instrument of appointment, directions, notices and draft findings by date
- Set out, beside each question in a notice, whether the notice says an answer is required

**AI must not:**

- Must not draft the person's evidence, a statement, or comments on proposed findings
- Must not say that answering is voluntary if a formal notice has been given
- Must not advise the person to discuss their evidence with another witness

**The lawyer checks:**

- A formal notice under the Inspector-General of the Australian Defence Force Regulation 2016 is distinguished from a request to answer voluntarily
- Any proposed finding that is critical, or that affects the person's interests, is answered in the time the inquiry allows, by the lawyer with the person
- The person knows who the IGADF page says they may tell, and that a direction or a privacy notice may narrow that
