## When to use it

Use when acting for a buyer or seller of a ship registered on the Australian General Shipping Register, from contract to registration of the new owner, or when ownership passes by court order or on death. Use the AMSA forms current at the time of lodgement.

## How AI may be used

AI may prepare the closing checklist and fill the AMSA forms from the contract and register details; a lawyer checks title, the shares transferred, encumbrances and execution before anything is signed or lodged.

**AI may:**

- Fill the bill of sale and declaration of transfer fields from the contract and the register entry (ship name, official number, shares, parties)
- Build the closing timetable, including the 14-day notification date after purchase
- Cross-check names, official number and shares across the contract, the register extract and the forms

**AI must not:**

- Must not draft or fill any statutory declaration or other sworn document; the declarant's lawyer prepares it
- Must not state that title is clear or unencumbered without the lawyer's review of the register and searches
- Must not alter AMSA forms or produce a bill of sale in a format the regulations do not allow

**The lawyer checks:**

- The seller is the registered owner of the shares being sold, and any registered mortgage will be discharged at or before completion
- The bill of sale is completed by the registered owner and states the ship's name and official number, the shares transferred, and each seller's and buyer's name and address
- The buyer is eligible to keep the ship on the Australian register, or closure of the registration is arranged
- Originals, the fee payment reference and the certificate are lodged within 14 days of purchase
