A checklist for a NSW hotel or registered club seeking a gaming machine threshold increase: which band and range applies, whether a Class 1 or Class 2 local impact assessment is required, and the consultation and advertising steps.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Liquor, Gaming & Wagering Licensing](https://ailawframework.com/precedents/liquor-gaming-and-wagering-licensing.md)
- Jurisdictions: New South Wales
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the 2 authorities it cites, for New South Wales.

## When to use it

Use when a NSW hotel or registered club wants more gaming machines than its current gaming machine threshold. Confirm the SA2 band and the size of the increase before drafting. Do not use the checklist as the LIA. Follow the current ILGA guideline and the approved form.

## How AI may be used

AI may sort the venue's SA2 band, the size of the increase and the consultation list from public data. The lawyer decides the class of LIA and checks every claim about harm, benefit and consultation before lodgement.

**AI may:**

- From the band and the number of machines sought, mark which cell of the published table applies and whether an LIA is required
- Build a consultation list of council, police, the local health district and the service types named on the Liquor & Gaming NSW page
- Compare dates of notices, advertisements and the lodgement against the seven-day, 60-day and 90-day periods

**AI must not:**

- Must not assert a positive contribution or an overall positive impact without evidence the applicant has approved
- Must not describe consultation that is not in the file
- Must not state that an area cap has or has not been reached unless the figure is taken from a current Liquor & Gaming NSW or ILGA source

**The lawyer checks:**

- Band, SA2 and the low, mid or high range are confirmed, including the Band 1 exception for an increase of 20 or fewer
- Fairfield LGA and any Band 3 restricted-increase cap are checked before the application is promised
- Class 1 notice within seven days of lodgement, or Class 2 consultation of at least 90 days before lodgement, is diarised and evidenced
- The LIA uses the current guideline and the applicant has approved every benefit and harm statement
