## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Insurance Law](https://ailawframework.com/precedents/insurance-law.md)
- Jurisdictions: United States
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22

## When to use it

Use when an insurer has written to reserve rights or to disclaim. Do not use it to argue the merits of the underlying claim. Do not use New York Insurance Law § 3420(d) unless the lawyer decides that subsection applies.

## Used for these tasks

- [Draft a coverage-position letter from the approved issues table](https://ailawframework.com/practice/insurance-law/draft-a-coverage-position-letter-from-the-approved-issues-table.md)
- [Draft claims-handling advice from the policy and the claim file](https://ailawframework.com/practice/insurance-law/draft-claims-handling-advice-from-the-policy-and-the-claim-file.md)
- [Summarise a claims file and policy for a coverage review](https://ailawframework.com/practice/insurance-law/summarise-a-claims-file-and-policy-for-a-coverage-review.md)

## How AI may be used

AI may quote the insurer's letter and list the policy provisions the insurer cites. The lawyer decides whether any statute applies and what, if anything, is conceded.

**AI may:**

- Quote the insurer's grounds from the letter, without adding one
- Ask for the policy provisions and the facts the insurer relies on
- Flag any sentence that agrees coverage is unavailable

**AI must not:**

- Must not agree that a reservation or a disclaimer is effective
- Must not waive a known or unknown right
- Must not file a lawsuit or send the letter

**The lawyer checks:**

- The response tracks the insurer's actual letter
- Section 3420 is used only inside the New York box, and only if the lawyer ticks it
- The letter is not an affidavit and not a complaint

## Authorities

- [N.Y. Ins. Law § 3420(d)(2) and § 3420(a)(6) (written disclaimer as soon as reasonably possible; a 60-day path where a late-notice disclaimer concerns death or personal injury). Senate site, revision shown as July 3, 2026.](https://www.nysenate.gov/legislation/laws/ISC/3420)
