## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Insurance Law](https://ailawframework.com/precedents/insurance-law.md)
- Jurisdictions: United States
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the authority it cites, for United States.

## When to use it

Use beside a tender or a disclaimer when the policy may have been issued or delivered in New York. Do not use it as a multi-state survey. No other state's statute was opened.

## Used for these tasks

- [Build a notification and prejudice chronology from the claim correspondence](https://ailawframework.com/practice/insurance-law/build-a-notification-and-prejudice-chronology-from-the-claim-corresponde.md)
- [Review the policy wording and draft a coverage advice table](https://ailawframework.com/practice/insurance-law/review-the-policy-wording-and-draft-a-coverage-advice-table.md)

## How AI may be used

AI may enter dates from the policy, the claim, and the insurer's letter. The lawyer decides which subsection applies and whether notice was good.

**AI may:**

- Enter dates and the place of the accident from the documents
- Leave the conclusion column blank
- Keep subsection (d)(1)'s policy-limits request separate from subsection (d)(2)'s disclaimer

**AI must not:**

- Must not decide that notice was timely or that the insurer was prejudiced
- Must not apply these provisions outside New York Insurance Law § 3420
- Must not draft a declaratory judgment complaint

**The lawyer checks:**

- The policy's place of issue is taken from the declarations or marked unknown
- Subsection (g) has been read before anyone treats subsection (a) as applicable
- The worksheet states no conclusion
