An original reservation of rights letter for an insurer that identifies the specific policy provisions and facts in question, explains what the insurer will do meanwhile, sets out the insured's rights under the Code and the Act, and asks for the information needed to decide.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Insurance Law](https://ailawframework.com/precedents/insurance-law.md)
- Jurisdictions: Australia
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the 4 authorities it cites, for Australia.

## When to use it

Use when an insurer needs to investigate before confirming or declining indemnity, particularly under a liability policy where defence steps cannot wait. Do not use as a blanket reservation without reasons, or to delay a decision that could already be made.

## How AI may be used

AI may draft from the approved coverage table and claim chronology, but the provisions reserved, the reasons and the interim position must be accurate, timely and not misleading, so a lawyer settles the letter.

**AI may:**

- Draft the letter from a lawyer-approved coverage table and chronology
- List each provision reserved with the facts said to engage it
- Check the letter against the Code paragraphs on claim timeframes and information requests

**AI must not:**

- Must not add generic reservations that are not tied to identified facts
- Must not state facts that the claim file does not support
- Must not set deadlines that conflict with the Code or the policy

**The lawyer checks:**

- Each reserved provision is genuinely in issue on the known facts
- The letter is sent promptly after the issue becomes known
- The interim position (defence, costs, consent) is clear and commercially agreed
- The insured is told about complaints, IDR and AFCA
