## When to use it

Use when an insurer has declined a claim, cancelled or avoided a policy, or reduced a payment because of something the insured did or did not say before the contract was entered into or renewed. Choose the consumer or non-consumer section first.

## Used for these tasks

- [Build a non-disclosure or misrepresentation table from application and claim](https://ailawframework.com/practice/insurance-law/build-a-non-disclosure-or-misrepresentation-table-from-application-and-c.md)

## How AI may be used

AI may build the table comparing the proposal questions, the answers given and what the insurer says was not disclosed; the lawyer decides which duty applies, whether the insurer's case is made out and what the letter asserts.

**AI may:**

- Extract each proposal or renewal question and the answer given into a comparison table
- Match the insurer's allegations to the documents and list what evidence the insurer has not provided
- Draft the factual sections of the letter from the verified table

**AI must not:**

- Must not decide whether the contract is a consumer insurance contract or whether a failure was fraudulent
- Must not assert what the insurer would have done (underwriting) without evidence from the insurer
- Must not make statements about the insured's knowledge or state of mind that the client has not confirmed

**The lawyer checks:**

- Whether the policy is a consumer insurance contract (s 20B applies) or another contract (s 21 applies), at the relevant inception or renewal
- For s 21, whether the insurer gave the written s 22 notice; if not, it cannot rely on non-fraudulent non-disclosure
- Whether the insurer has shown it would not have entered into the contract on the same terms (s 28(1)) and, if reducing, how it calculated the prejudice (s 28(3))
- Every factual statement in the letter has been confirmed by the client and the documents
