## When to use it

Use when a person may claim against the insurer of a company that has been deregistered. Do not use it because the company is in liquidation or under administration but still registered.

## Used for these tasks

- [Prepare a claim directly against the liability insurer of an insolvent or deregistered defendant](https://ailawframework.com/practice/insurance-law/prepare-a-claim-directly-against-the-liability-insurer-of-an-insolvent-o.md)

## How AI may be used

AI may enter the company name, ACN and the deregistration date from a search. It must not say that section 601AG is satisfied or draft the claim.

**AI may:**

- Enter the company name, ACN and any deregistration date printed on a company search in the file
- List the insurance contracts in the file and their periods
- Leave blank any element that is not in a document

**AI must not:**

- Must not decide that the company had a liability to the person
- Must not decide that the contract covered that liability immediately before deregistration
- Must not draft the claim, the pleading or a letter of demand

**The lawyer checks:**

- The company search shows deregistration, not only external administration
- The amount claimed is an amount that was payable to the company under the contract
- Section 51 is not used as if it were section 601AG
