Original letter responding to a section 57 invitation, addressing each item of adverse information with evidence, dealing with PIC 4020 risks and any request for more time, and keeping every factual assertion tied to client-verified evidence.

- Practice area: [Immigration & Migration Law](https://ailawframework.com/precedents/immigration-and-migration-law.md)
- Jurisdictions: Australia
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.

## When to use it

Use when the Department invites a visa applicant to comment on information that may be the reason (or part of the reason) for refusal. Respond within the period in the invitation. Do not use it to respond to a notice of intention to consider cancellation, which follows a different regime.

## How AI may be used

AI may structure the response around each item of adverse information and organise evidence, under the lawyer's or agent's direction. Every factual assertion must be checked with the client and documents, because false or misleading information triggers PIC 4020 and may be an offence.

**AI may:**

- Turn the invitation into a numbered table of each item of adverse information with candidate evidence references
- Draft a first version of the response from facts the client has confirmed in writing
- Prepare an evidence index and check that every document referred to is attached

**AI must not:**

- Must not draft or "improve" the client's own statement or declaration
- Must not add facts, explanations or dates the client has not confirmed
- Must not calculate the response deadline as the only control

**The lawyer checks:**

- Every item of adverse information is answered and every fact is supported by evidence or the client's confirmed account
- The response is lodged within the period in the invitation, or an extension is sought in time
- PIC 4020 consequences are explained to the client in writing
- Translations are accurate and meet Department requirements
