## When to use it

Use when a patient, a parent or guardian, or another person chosen by the patient, complains in writing to the Health Care Complaints Commission about a health service in NSW. The online portal was not opened, so its screens are not described.

## Used for these tasks

- [Index a health-complaint file for material the damages claim cannot use](https://ailawframework.com/practice/health-and-medical-law/index-a-health-complaint-file-for-material-the-damages-claim-cannot-use.md)

## How AI may be used

The tool may list providers and dates already on the file, and it writes nothing in the account of what happened or in the signed consent to health information.

**AI may:**

- List the providers named on the file against section 4, including an AHPRA number if one is already recorded
- Index letters, reports and invoices the lawyer has marked for attachment
- Note whether section 6 is the patient's own consent, a parent or guardian, or a third party who still needs the patient's signed consent

**AI must not:**

- Must not write section 5, the account of what happened, who was involved, or what the complainant wants to happen
- Must not write or sign section 6, the consent to access health information, or the separate authority the form asks the patient to sign
- Must not decide that the Commission can deal with the complaint, or tell the client the Commission can order compensation, a refund, treatment, or a change to a medico-legal report
- Must not describe the screens of the online portal. That portal was not opened

**The lawyer checks:**

- The form in use is the current one. The PDF opened on 23 October 2026 has a file name of September 2020. The make-a-complaint page was last updated on 14 September 2026 and still links that PDF, and also links the online portal
- Any person may complain, including a parent or guardian or a representative chosen by the person. Written authority assists, and is needed if the Commission requires the records. That page says authority is not required if the person is under 14 or has died. The form separately asks whether the person is a child under 16
- Section 1 records whether the provider was spoken to first, and attaches any response. The form says it is an offence to give the Commission false or misleading information
- Consent to share the complaint with the provider is addressed. The form says that without it the Commission may not be able to assess the complaint
- Section 6 matches the speaker: the person who received the service, the next of kin or parent or guardian, a third party, or a person who is not acquainted with the patient. A third party and a person who is not acquainted are told to send the patient's signed consent within 10 days
- The Commission's own limits are explained before the complaint is sent: it says it cannot direct a provider to pay compensation, give a refund or change fees, provide treatment, or alter a medico-legal document
- Copies are sent. The form says not to send original documents
- Health and other personal information stays in a firm-controlled tool. Check confidentiality under ASCR r 9 and APP 11, and whether any breach is notifiable under the Privacy Act 1988 (Cth).
