Letter for a registered health practitioner responding to a National Board's notice of proposed immediate action or request for a response to a notification: addresses the statutory test, offers less restrictive alternatives and supplies evidence, without unnecessary admissions.

## When to use it

Use when a practitioner receives a show cause notice for proposed immediate action (s 157) or an invitation to respond to a notification under the National Law. In NSW most conduct complaints are handled by the Health Care Complaints Commission and professional councils, so rework it for that process.

## How AI may be used

Lawyer-led. AI may extract the concerns from the notice and index the clinical file, but the response is an admission-sensitive document the lawyer settles with the practitioner, and patient records stay in approved secure tools.

**AI may:**

- Extract each concern and particular from the notice, in the notice's own words, into a table with the response date.
- Index the clinical records, references and CPD documents the lawyer has cleared, with dates.
- List concerns the documents do not address, for the lawyer to raise with the practitioner.

**AI must not:**

- Must not draft the practitioner's account of events, explanations or expressions of insight.
- Must not process patient records or the practitioner's health information in a tool not approved for sensitive information.
- Must not characterise the notifier or the patient.

**The lawyer checks:**

- The response deals with the statutory test the Board must apply, not only the merits of the complaint.
- Every factual statement is confirmed by the practitioner and the records.
- The practitioner's indemnity insurer has been notified and consents where the policy requires.
- Patient information in the response is limited to what is necessary.
