Supplier's written complaint to the accountable authority of a Commonwealth entity under the Government Procurement (Judicial Review) Act 2018, identifying the CPR contraventions, triggering the statutory investigation and suspension, and preserving the right to seek an injunction or compensation.

## Key facts

- Kind: Letter. A letter or email you adapt and send.
- Practice area: [Government Procurement & Tendering](https://ailawframework.com/precedents/government-procurement-and-tendering.md)
- Jurisdictions: Australia, Commonwealth, United Kingdom (England and Wales)
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the 6 authorities it cites, for Australia, Commonwealth and United Kingdom (England and Wales).

## When to use it

Use urgently when a supplier believes a Commonwealth entity has contravened, or will contravene, the relevant CPRs in a covered procurement that affects the supplier. Do not use for state procurements or for procurements below the threshold or exempt under Appendix A, which are not covered procurements.

## How AI may be used

AI may build the chronology from the evaluation file and map conduct against the CPR paragraphs the lawyer has identified, but whether the procurement is covered, which provisions were contravened, and the strict timing are for the lawyer.

**AI may:**

- Build a chronology of publication, clarification, closing, evaluation, notification and debrief from the documents.
- Map each event against CPR paragraphs the lawyer has selected and list the documents that evidence it.
- Draft the factual section of the letter for the lawyer to revise.

**AI must not:**

- Must not decide whether the procurement is a covered procurement or whether an exemption applies.
- Must not calculate the 10-day injunction deadline without the lawyer confirming the date of awareness.
- Must not include confidential information of other tenderers obtained improperly.

**The lawyer checks:**

- The procurement is covered (Divisions 1 and 2 of the CPRs apply and it is not excluded by determination).
- The date the client became aware (or ought to have become aware) of each contravention, and the 10-day period for an injunction application.
- Whether a public interest certificate is in force, which affects suspension.
- That the client is ready to apply to the Federal Court or FCFCOA (Division 2) promptly if needed.
