Guide to the mandatory NSW Government ICT Purchasing Framework: when to use Core& or MICTA/ICTA, how the master and customer contracts fit together, what suppliers can negotiate, and how AI procurements interact with the NSW AI Assessment Framework.

## Key facts

- Kind: Agreement. A contract between two or more parties.
- Practice area: [Government Procurement & Tendering](https://ailawframework.com/precedents/government-procurement-and-tendering.md)
- Jurisdictions: New South Wales
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-17
- Status: Maintained. Checked on 2026-10-17 against the official form at info.buy.nsw.gov.au and the 3 authorities it cites, for New South Wales.

## When to use it

Use when advising a NSW Government agency buying ICT goods or services, or a supplier contracting with one. Always use the current documents from buy.nsw. Not for Commonwealth procurements, which use the CCS or other Commonwealth contracts.

## How AI may be used

AI may produce a deviation table comparing a supplier's proposed terms with the MICTA/ICTA or Core& documents, but parties must work from the current official framework documents and the lawyer settles every departure.

**AI may:**

- Compare a supplier's proposed changes with the current MICTA/ICTA or Core& terms and produce a deviation table.
- Map the ICTA modules and order form fields to the agency's requirements and list gaps.
- Summarise the risk-assessment guidelines into questions for the agency's project team.

**AI must not:**

- Must not produce a rewritten version of the framework terms for signature.
- Must not decide whether a procurement is high risk or which framework applies.
- Must not enter agency data into tools not approved under NSW Government policy.

**The lawyer checks:**

- The correct framework is used based on risk and value, and the documents are the current versions from buy.nsw.
- Any departures are approved through the agency's process and recorded.
- If the ICT includes AI, the AI use case has been registered and assessed under the NSW AI Assessment Framework as required.
