A declaration for each evaluation committee member, adviser and observer in a government procurement: confidentiality undertakings, disclosure of actual, potential and perceived conflicts, gifts and hospitality, AI-tool rules and a continuing duty to update.

## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Government Procurement & Tendering](https://ailawframework.com/precedents/government-procurement-and-tendering.md)
- Jurisdictions: Australia, Commonwealth
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 4 authorities it cites, for Australia and Commonwealth.

## When to use it

Have every person who will see submissions or take part in evaluation sign it before they receive any tender material, and again if the list of tenderers changes. Built for Commonwealth procurements under the CPRs; adapt the references for state and local government.

## Used for these tasks

- [Prepare the probity plan and the conflict-of-interest register for the evaluation](https://ailawframework.com/practice/government-procurement-and-tendering.md#A50-X20260927-5)
- [Check the signed probity and conflict declarations against the procurement papers](https://ailawframework.com/practice/government-procurement-and-tendering.md#A50-X20260927-6)

## How AI may be used

AI may fill the procurement particulars and tenderer list into the approved form and keep the conflict register, but each declarant completes their own disclosures and the delegate or probity adviser decides how any conflict is managed.

**AI may:**

- Insert the procurement name, reference, tenderer and subcontractor names and the declarant’s role into the approved form
- Copy the disclosures from signed forms into the conflict-of-interest register and list forms not yet returned
- Flag declarations that name a tenderer, a related entity or a gift so the probity adviser can review them

**AI must not:**

- Must not complete or suggest answers to the disclosure questions for the declarant
- Must not decide that a disclosed interest is not a conflict, or choose the management strategy
- Must not be given access to submissions or evaluation material in a tool that retains inputs, trains on them or is not approved for the material’s security classification

**The lawyer checks:**

- Every person on the evaluation, advisory and approval list has signed before receiving any submission, with the signed date recorded
- The tenderer list in the form is complete, including consortium members and key subcontractors named in submissions
- Each disclosed interest has a recorded decision and management strategy approved by the right person, and the register is kept on the procurement file
- The form is re-signed when tenderers, panel membership or the declarant’s circumstances change
