## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Family Violence & Protection Orders](https://ailawframework.com/precedents/family-violence-and-protection-orders.md)
- Jurisdictions: Australia, New South Wales
- AI level: Green. The tool writes the first draft inside a template you have already tested. You check it. Without that test, first drafting starts at Yellow.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the 2 authorities it cites, for Australia and New South Wales.

## When to use it

Use when an order is made, served, varied or about to expire, and keep it current for the life of the order. Read the period off the order. Do not calculate an ADVO expiry from section 79.

## Used for these tasks

- [Build the order, service and expiry register](https://ailawframework.com/practice/family-violence-and-protection-orders/build-the-order-service-and-expiry-register.md)

## How AI may be used

AI may enter the date, the period and the service detail as they appear on the order and the affidavit of service. It does not calculate an expiry that is not written down.

**AI may:**

- Copy the order date, the period specified, and the names from the order into a row
- Copy the service date from an affidavit of service
- For an APVO that specifies no period, enter 12 months from the date the order was made and mark the row as using s 79(3)

**AI must not:**

- Must not apply section 79 to an apprehended domestic violence order
- Must not invent an expiry date for an ADVO
- Must not decide that service was effective

**The lawyer checks:**

- Each ADVO expiry is the period stated on that order, checked against the duration provision for domestic orders, which is not section 79
- An APVO with no period is given 12 months under s 79(3), and the lawyer has confirmed the order is a personal violence order
- Section 79 is subject to section 73 (variation or revocation). A variation is a new row, not an overwrite
- Service or presence is recorded because s 14(2) makes it an element of a contravention offence
