Guide to the Local Court application to vary, revoke or extend a final or interim AVO: who may apply, when leave is needed, how to state the grounds and the variation sought, service, police-initiated orders and the hearing.

## Key facts

- Practice area: [Family Violence & Protection Orders](https://ailawframework.com/precedents/family-violence-and-protection-orders.md)
- Jurisdictions: New South Wales
- AI level: Red. Keep AI out of the decisive steps. A lawyer does the work.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 6 authorities it cites, for New South Wales.

## When to use it

Use when a protected person, defendant or other interested party asks the firm to change, end or extend an apprehended violence order made in NSW, or to respond to such an application. For an order made in another state or territory, read the national recognition checklist in this library first.

## Used for these tasks

- [Build the incident chronology and evidence index for the protection order file](https://ailawframework.com/practice/family-violence-and-protection-orders.md#A53-X20260927-1)

## How AI may be used

The lawyer writes the grounds and the variation sought; AI may build the chronology of changed circumstances and check dates, names and order numbers against the sealed order.

**AI may:**

- Build a dated chronology of events since the order was made from the client’s documents, for the lawyer to test
- Check the order number, dates, parties and condition numbers in the application against the sealed order
- Prepare the service and filing checklist and the diary dates for the lawyer to confirm

**AI must not:**

- Must not write the grounds, the variation sought or any statement the client will sign or rely on in court
- Must not decide whether there has been a change in circumstances or whether leave should be sought
- Must not include the protected person’s residential address in any draft, note or prompt
- Must not contact the other party, police or the court

**The lawyer checks:**

- The applicant is an interested party or a police officer (s 72A(2)) and, for a police-initiated order protecting a child, leave is sought on a ground in s 72B(2)
- The grounds show a change in circumstances, so the application is not in the nature of an appeal (s 73(3))
- For an extension, the application is lodged before the expiry date on the sealed order
- Notice will be served personally, or as the court directs, on each protected person or the defendant, and on the Commissioner for a police-initiated order (ss 72C, 73(4) to (6))
- Where there are several protected persons, any variation affecting another protected person has their consent and they are at least 16 (s 74(3))
