## When to use it

Use when police or a protected person report a possible breach of a New South Wales apprehended violence order, before anyone advises on plea or charge.

## Used for these tasks

- [Build the contravention analysis from the police brief and the served order](https://ailawframework.com/practice/family-violence-and-protection-orders/build-the-contravention-analysis-from-the-police-brief-and-the-served-or.md)

## How AI may be used

AI may line up the condition, the alleged conduct and the dates from the brief. The lawyer decides the offence and the advice.

**AI may:**

- Quote the condition from the served order into one column and the alleged conduct from the brief into another
- Count dated alleged contraventions in the 28 days before the latest one and list them
- Note whether the brief states the defendant was served or was in court when the order was made

**AI must not:**

- Must not say which subsection is proved or advise a plea
- Must not describe subsection (9), which was not read
- Must not draft the facts sheet or the defence statement

**The lawyer checks:**

- The order in the worksheet is the order that was in force, and the condition allegedly breached is quoted from it
- Knowledge, service or presence (subsection (2)), and the exceptions in subsection (3), are each addressed
- A subsection (1C) charge is checked against two other knowing contraventions within the 28 days immediately before, and against the reasonable-person test
- The protected person is not treated as a party to an offence of aiding a contravention (subsection (7))
