## Key facts

- Kind: Other. A precedent that fits none of the other kinds.
- Practice area: [Family Law](https://ailawframework.com/precedents/family-law.md)
- Jurisdictions: Australia
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the authority it cites, for Australia.

## When to use it

Use when both parents are prepared to write down arrangements for a child and it is safe to do so. A plan is not a parenting order. Do not use it to record a history of family violence.

## Used for these tasks

- [Draft a parenting plan or parenting orders from the arrangements sheet](https://ailawframework.com/practice/family-law/draft-a-parenting-plan-or-parenting-orders-from-the-arrangements-sheet.md)
- [Turn existing parenting orders into a practical arrangements sheet](https://ailawframework.com/practice/family-law/turn-existing-parenting-orders-into-a-practical-arrangements-sheet.md)

## How AI may be used

AI may place the parents' agreed arrangements under these headings; the lawyer checks that each arrangement is specific, safe, and agreed, and that the plan is not treated as an order.

**AI may:**

- Sort an arrangements sheet into the topics the fact sheet lists
- Leave a heading blank where the parents have not agreed
- Remind the file that the fact sheet says there is no presumption of equal time or of equal shared decision-making

**AI must not:**

- Must not invent arrangements the parents have not agreed
- Must not write a narrative of family violence, or any affidavit, into the plan
- Must not describe the plan as enforceable, or file it as consent orders, unless the lawyer has taken that separate step

**The lawyer checks:**

- Both parents will sign and date the plan, and it is made free from threat, duress or coercion
- Safety of the child and of the people who care for the child has been considered before any plan is proposed
- If an existing parenting order is being changed, the order does not forbid a later plan, and the parents are told that inconsistent parts of the old order may not be enforceable
- Child support is not given a figure in the plan until the special rules the fact sheet points to have been read
