Pre-lodgement checklist for a NSW mining lease holder's royalty return: who is liable, which minerals, the rate in force when the material was extracted, value and deductions, exemptions and deferrals, the return to the Chief Commissioner and payment timing.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Energy, Resources & Mining](https://ailawframework.com/precedents/energy-resources-and-mining.md)
- Jurisdictions: New South Wales
- AI level: Yellow. AI can help in set ways. A lawyer checks specific points before use.
- Law stated as at: 2026-10-18

## When to use it

Use each royalty period before a lease or sublease holder lodges its return, and when advising on an assessment, objection or audit by Revenue NSW. Pair it with the operation's production and sales data and the current regulations, which set rates and timing.

## How AI may be used

AI may reconcile production, sales and stock data into the return workpapers and flag variances; the lawyer or tax adviser checks liability, the rate, the valuation and any exemption or deferral before the return is lodged.

**AI may:**

- Reconcile tonnes extracted, processed and sold for the period from the mine's production and sales records
- Apply the rate table the adviser has confirmed and show the calculation line by line
- Flag variances against prior periods and any changes in the sublease or ownership position

**AI must not:**

- Must not choose the rate, valuation method or allowable deductions; those come from the current regulations and the adviser
- Must not treat a mineral as exempt, or a deferral as in effect, without the approval on file
- Must not lodge the return

**The lawyer checks:**

- The person liable is the holder of the lease or sublease at the time the minerals were recovered (s 282(1C)), and sublease payments are credited correctly
- The rate applied is the one in force when the material was extracted (s 283(2)) and the valuation follows the current regulations
- Any exemption, waiver or deferral approval relied on is current and its conditions are met
