Written notice under the federal Worker Adjustment and Retraining Notification Act before a plant closing or mass layoff. It is served 60 days before the order, unless a statutory exception applies, and it is not a state mini-WARN notice.

## Key facts

- Kind: Notice. A formal notice to serve or publish.
- Practice area: [Employment & Workplace Relations](https://ailawframework.com/precedents/employment-and-workplace-relations.md)
- Jurisdictions: United States
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the 3 authorities it cites, for United States.

## When to use it

Use when a business enterprise that meets the federal employer test will order a plant closing or a mass layoff at a single site. Give a separate notice to the state rapid-response entity and to the chief elected official. Check the state's own notice statute before relying on this federal form alone.

## How AI may be used

AI may fill site, dates and headcount from a spreadsheet the lawyer has checked, and list which of the three statutory recipients have no draft. The lawyer decides whether notice is required and whether an exception applies.

**AI may:**

- Fill the site, the expected date and the counts from a headcount sheet the lawyer has marked as checked
- List affected employees who have no notice draft, where there is no exclusive representative
- Compare the draft with the recipient list in § 2102(a)

**AI must not:**

- Must not decide that a plant closing or mass layoff will occur
- Must not apply the faltering-company, unforeseeable-business-circumstances or natural-disaster exception
- Must not send the notice

**The lawyer checks:**

- The employer and the event meet § 2101, using the part-time and employment-loss definitions, including the 90-day aggregation in § 2102(d)
- Notice goes to the representative or each affected employee, to the state rapid-response entity, and to the correct unit of local government, 60 days before the order unless a § 2102(b) exception is documented
- On a sale of a business, the seller or the buyer is the party § 2101(b) makes responsible, and any state notice statute has been checked separately
