Written notice to an overseas student that the provider intends to report unsatisfactory course progress or attendance, and of the 20 working day internal complaints and appeals period in the Department of Education Standard 8 fact sheet.

## Key facts

- Kind: Notice. A formal notice to serve or publish.
- Practice area: [Education Law](https://ailawframework.com/precedents/education-law.md)
- Jurisdictions: Commonwealth
- AI level: Yellow. You and the tool draft together, with you directing. You check every statement you rely on.
- Law stated as at: 2026-10-22
- Status: Maintained. Checked on 2026-10-22 against the 2 authorities it cites, for Commonwealth.

## When to use it

Use when a registered provider has assessed that an overseas student is not meeting course progress or attendance requirements under the provider's policies, and before anything is reported in PRISMS.

## Used for these tasks

- [Prepare the intention-to-report notice for unsatisfactory course progress](https://ailawframework.com/practice/education-law/prepare-the-intention-to-report-notice-for-unsatisfactory-course-progres.md)

## How AI may be used

The tool drafts the notice from the assessment the lawyer supplies, and the lawyer checks the policy breach and the appeal wording before the notice is given to the student.

**AI may:**

- Insert the student identifier, course and the policy breach the lawyer supplies.
- State the right to access the provider's internal complaints and appeals process within 20 working days, as the fact sheet states it.
- List the four situations in which the fact sheet says a breach may be reported in PRISMS.

**AI must not:**

- Do not report the student in PRISMS.
- Do not name an external complaints body. The fact sheet does not name one in the passage that was used.
- Do not decide that the student has failed to meet the requirement.

**The lawyer checks:**

- Confirm the assessment was made under the provider's own course-progress or attendance policy.
- Confirm whether an intervention strategy was required before this notice. The fact sheet says providers must assist a student at risk through an intervention strategy.
- Do not treat the 70 per cent attendance exception as a general rule. It is limited to the cases the fact sheet states.
