A lawyer's checklist for advising a student accused of unauthorised AI use or other academic misconduct: reading the allegation and policy, testing the evidence, gathering the student's own drafts and records, deadlines, and an outline for a response the student writes in their own words.

## Key facts

- Kind: Checklist. Steps or checks to work through and tick off.
- Practice area: [Education Law](https://ailawframework.com/precedents/education-law.md)
- Jurisdictions: Australia
- AI level: Red. Keep AI out of the decisive steps. A lawyer does the work.
- Law stated as at: 2026-10-18
- Status: Maintained. Checked on 2026-10-18 against the 3 authorities it cites, for Australia.

## When to use it

Use when a university or other higher education student receives an allegation of academic misconduct, especially one based on AI detection results, writing style or unusual output. Start on receipt: provider deadlines are short. The student's account must be the student's own.

## How AI may be used

AI may organise the allegation, the policy and the student's drafts and version history; it writes nothing that goes into the student's response, which the student writes and the lawyer reviews.

**AI may:**

- Summarise the allegation letter, the evidence attached and the policy steps and deadlines
- Index the student's drafts, file version history, notes, sources and permitted-tool use by date
- List questions to ask the provider about the evidence relied on

**AI must not:**

- Must not write or rewrite any part of the student's response or explanation
- Must not assess whether the student used AI or whether a detection result is accurate
- Must not process the student's assessment, drafts or personal information in a tool outside the approved environment

**The lawyer checks:**

- The allegation, the policy provision relied on and the assessment's AI-use rules identified precisely
- The evidence relied on obtained and tested, including how any detection result or comparison was produced and interpreted
- The student's response is in their own words, accurate and consistent with their records
- Deadlines, hearing rights, support person rights and internal appeal and external complaint options diarised
