## Used for these tasks

- [Draft particulars of a liquidated claim](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement/draft-particulars-of-a-liquidated-claim.md)
- [Check the claim pack against the current form, fee and registry rules before filing](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement.md#A46-X20260927-1)
- [Draft default or summary-judgment papers from the liquidated file](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement.md#A46-A20260923-1)
- [Assemble the service evidence before asking for default judgment](https://ailawframework.com/practice/debt-recovery-and-civil-enforcement.md#A46-X20260927-3)

## How AI may be used

AI may draft the particulars of a liquidated claim from the contract, invoices and ledger and check the claim pack against the court's forms; the lawyer checks every figure and allegation in each claim, and the service affidavit is the server's own sworn evidence.

**AI may:**

- Draft the particulars of the debt (contract, invoices, payments, balance, interest) from the ledger and documents, for the lawyer to check line by line
- Reconcile the amount claimed, interest and costs to the ledger, with a source for every figure
- Check the claim pack against the current forms, copies and filing steps, and list gaps
- Calculate the service, response and default dates from the filing and service dates, for the lawyer to diarise

**AI must not:**

- Must not decide whether the claim is in time, in the right court, or against the right defendant
- Must not draft the affidavit of service or any other sworn evidence
- Must not sign, file or serve anything

**The lawyer checks:**

- Correct court for the amount: Magistrates Court up to $150,000; District Court $150,001 to $750,000; Supreme Court over $750,000 or complex
- Form 2 claim and Form 16 statement of claim signed, with originals and two copies of each filed, and the fee paid
- Sealed copies served personally within one year of filing (a company by post to its registered office or on a director)
- Form 46 affidavit of service sworn by the person who served, for each defendant
- No notice of intention to defend within 28 days of service before default judgment is requested
