## When to use it

Use when a Commonwealth matter may involve restraint or confiscation, to record which agency the CDPP page says has the function. State and territory confiscation Acts were not opened.

## Used for these tasks

- [Prepare a proceeds-of-crime or asset-restraint response pack](https://ailawframework.com/practice/criminal-law/prepare-a-proceeds-of-crime-or-asset-restraint-response-pack.md)

## How AI may be used

AI may record dates and which agency holds the file, from documents the lawyer supplies. The lawyer decides which statute and which applicant apply.

**AI may:**

- Enter the date any restraining order or confiscation action was commenced, if a document states it
- List the agencies named on the brief
- Flag that no restraining-order date has been recorded

**AI must not:**

- Must not draft a restraining order, forfeiture application or pecuniary penalty application
- Must not state the grounds or time limits in the Proceeds of Crime Act. The Act was not opened
- Must not apply a state or territory confiscation Act

**The lawyer checks:**

- Whether a restraining order had been sought when the application was made
- Whether any confiscation action was commenced before 1 January 2003
- Whether the matter is a corruption superannuation application, a prescribed narcotic dealings recovery, or a civil remedy connected with a prosecution

## Authorities
