## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Costs, billing & litigation funding](https://ailawframework.com/precedents/costs-billing-and-litigation-funding.md)
- Jurisdictions: Victoria
- AI level: Red. You write the text. The tool writes nothing into the document. Where permitted, it may check, clarify or collect data, and anything it checks or collects is verified.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the official form at vcat.vic.gov.au and the 3 authorities it cites, for Victoria.

## When to use it

Use this when a personal-injury client asks VCAT to decide a costs dispute with a lawyer, or a related legal-services claim. A Uniform Law costs dispute needs the Commissioner's notice. A claim above the figure on the VCAT page goes to the Costs Court instead.

## How AI may be used

The tool indexes the application fields and does not write the acknowledgement or choose the Act, the orders, or the grounds.

**AI may:**

- Index the parties, the amount claimed and the documents the page says to attach, from the file.
- Diary seven days from lodgement as the form's time to serve the respondent, and 60 days from the Commissioner's notice where the case-type page applies that limit.

**AI must not:**

- Do not write or sign the acknowledgement, and do not write a statutory declaration for a standard-fee claim.
- Do not select the Act, the orders, or the reasons in questions 17 and 18.
- Do not describe the claim in question 19. That is the client's account of the problem.
- Do not treat the Legal Services Board complaint times as this form's time limit.

**The lawyer checks:**

- The case-type page says a Uniform Law costs dispute requires that the Commissioner has dealt with it and not resolved it, and that the costs in dispute are less than $78,585 for applications made after 30 June 2025. Above that figure the page sends the claim to the Costs Court.
- The same page says the application must be made within 60 days after the Commissioner's written notice. If that limit is about to expire, the page says to contact VCAT rather than assume the form can be lodged late.
- The form says the application must be served on the respondent within seven days, with evidence of service at the hearing.
- The acknowledgement warns that it is an offence under section 136 of the Victorian Civil and Administrative Tribunal Act 1998 to knowingly give false or misleading information.
- A company claiming the standard fee must provide a statutory declaration. The tool does not write it.
- The form prints admin@courts.vic.gov.au and 1300 01 8228, 9am to 4.30pm weekdays. The case-type page's visible text prints the same email, and its link target is admin@vcat.vic.gov.au. Check which inbox is current.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
