- Status: Maintained. Checked on 2026-10-23 against the official form at supremecourt.vic.gov.au and the 3 authorities it cites, for Victoria.

## When to use it

Use this when a party-party or lawyer-client costs dispute is to be taxed in the Costs Court and a hearing date has been set. File it with the bill of costs and the matching taxation information form. It is not the gross-sum summons.

## Used for these tasks

- [Record the 12-month date for a costs assessment application](https://ailawframework.com/obligations/costs-billing-and-litigation-funding.md#A42-PE20261022-12)
- [Build a draft bill from the time records and the disclosure](https://ailawframework.com/obligations/costs-billing-and-litigation-funding/build-a-draft-bill-from-the-time-records-and-the-disclosure.md)

## How AI may be used

The tool indexes the summons headings and does not write a notice of objection or any affidavit.

**AI may:**

- Index the parties, the costs order or legislation, and the date the bill was served, from documents already on the file.
- Diary seven days before the hearing date as the form's deadline to file and serve a notice identifying each objected item.

**AI must not:**

- Do not write the notice that identifies objected items. The summons tells the respondent to file that notice. It is not part of this form.
- Do not draft the affidavit the lawyer-client page requires for an application to a Judge to extend time.
- Do not choose whether the dispute is lawyer-client or party-party, and do not name the legislation.
- Do not copy the gross-sum summons wording onto this form.

**The lawyer checks:**

- The form page cites Order 63 of the Supreme Court (General Civil Procedure) Rules 2025. The party-party costs page cites the 2015 rules for the under-$100,000 assessment and the over-$100,000 mediation. Read both pages and Practice Note SC Gen 11 before filing.
- The summons says costs claimed in the bill may be allowed, whether or not the respondent attends, unless at least seven days before the hearing the respondent files and serves a notice identifying each item objected to.
- For a lawyer-client dispute the form says to insert the legislation that applies. The lawyer-client page sets that by the date the lawyer was first instructed.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
