## Key facts

- Kind: Form. A form to complete, or a guide to completing an official one.
- Practice area: [Costs, billing & litigation funding](https://ailawframework.com/precedents/costs-billing-and-litigation-funding.md)
- Jurisdictions: Victoria
- AI level: Red. You write the text. The tool writes nothing into the document. Where permitted, it may check, clarify or collect data, and anything it checks or collects is verified.
- Law stated as at: 2026-10-23
- Status: Maintained. Checked on 2026-10-23 against the official form at supremecourt.vic.gov.au and the 3 authorities it cites, for Victoria.

## When to use it

Use this when the Costs Court is asked to determine costs on a gross-sum basis, or a judge has already ordered a gross sum. File it with the gross sum information form and a schedule of invoices. It is not the summons for taxation.

## Used for these tasks

- [Build a draft bill from the time records and the disclosure](https://ailawframework.com/obligations/costs-billing-and-litigation-funding/build-a-draft-bill-from-the-time-records-and-the-disclosure.md)

## How AI may be used

The tool indexes the summons headings and does not choose which order alternative stays on the form.

**AI may:**

- Index the parties and the date and maker of the costs order from the order already on the file.
- Flag that the form says to delete whichever of the two order paragraphs does not apply.

**AI must not:**

- Do not delete either alternative, and do not name the judicial officer.
- Do not copy the seven-day objection notice from the taxation summons onto this form. It is not on the gross-sum summons that was opened.
- Do not draft an affidavit or minutes of consent.

**The lawyer checks:**

- The form page cites Order 63 of the Supreme Court (General Civil Procedure) Rules 2025 and Practice Note SC Gen 11, third revision.
- For a lawyer-client dispute the summons says to insert the legislation that applies. That choice is on the lawyer-client page, by the date of first instructions.
- The party-party page sets out two different filing bundles, one where a gross-sum order already exists and one where the party is applying for a gross sum instead of taxed costs.
- Health information stays in a firm-controlled tool. Check ASCR r 9, APP 11, and whether any disclosure would be a notifiable breach under the Privacy Act 1988 (Cth).
